Welcome to AvatarEnterprise.gy (“Platform”, “we”, “us”, “our”). By accessing, registering, or using this website, you agree to comply with and be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.
1. Nature of the Platform
AvatarEnterprise.gy is an online multi-vendor marketplace that allows independent vendors in Guyana to list and sell products or services to customers.
- Avatar Enterprise does not own, manufacture, store, or deliver any products listed by vendors.
- All transactions occur between buyers and vendors, with Avatar Enterprise acting solely as a facilitator.
2. Account Registration
To use certain features, you must create an account.
You agree to:
- Provide accurate and truthful information
- Keep login credentials secure
- Be at least 18 years old, or have parental consent
We reserve the right to suspend or terminate accounts that provide false information or violate these terms.
3. Vendor Responsibilities
Vendors using AvatarEnterprise.gy agree that they:
- Are legally allowed to sell the products or services listed
- Own or have legal rights to all items sold
- Are responsible for:
- Product accuracy
- Pricing
- Availability
- Quality
- Warranty (if any)
- Delivery or pickup arrangements
- Will comply with all applicable laws in Guyana
Prohibited Items
Vendors may NOT sell:
- Illegal, stolen, or counterfeit goods
- Weapons, drugs, or restricted items
- Fraudulent, misleading, or unsafe products
Avatar Enterprise reserves the right to remove listings without notice.
4. Customer Responsibilities
Customers agree that they:
- Understand Avatar Enterprise is not the seller
- Must read product descriptions carefully before purchasing
- Will communicate directly with vendors regarding:
- Delivery
- Refunds
- Product issues
5. Payments & Commission
- Avatar Enterprise charges a 5% commission on each completed sale.
- The remaining balance is transferred to vendors via:
- MMG
- Bank transfer
- Payout timelines may vary based on verification, volume, or technical delays.
Avatar Enterprise does not guarantee instant payouts.
6. Refunds, Returns & Disputes
- Refunds and returns are handled directly by vendors, unless otherwise stated.
- Avatar Enterprise is not obligated to issue refunds on behalf of vendors.
However, we may:
- Mediate disputes at our discretion
- Suspend vendors with repeated complaints
- Remove vendors who engage in fraudulent activity
7. Limitation of Liability
To the fullest extent permitted by law:
- Avatar Enterprise is not liable for:
- Product defects
- Financial loss
- Personal injury
- Delayed or failed deliveries
- Vendor misconduct
- All transactions are conducted at the user’s own risk
8. Platform Availability
We do not guarantee uninterrupted access to the Platform. Maintenance, updates, or technical issues may temporarily affect service.
9. Content & Intellectual Property
- Vendors retain ownership of their content
- By uploading content, you grant Avatar Enterprise permission to display and promote it
- Users may not copy, scrape, or misuse content without permission
10. Termination
We may suspend or terminate accounts that:
- Violate these terms
- Engage in fraud or abuse
- Harm other users or the platform’s reputation
11. Privacy
User data is handled in accordance with our Privacy Policy. We do not sell personal data to third parties.
12. Governing Law
These Terms & Conditions are governed by the laws of the Co-operative Republic of Guyana.
13. Changes to Terms
We reserve the right to update these terms at any time. Continued use of the Platform means acceptance of updated terms.
